This page describes the legal terms for using Dubavision services and the website dubavision.com. By accessing or purchasing our services you agree to these terms. Upon accepting a commercial collaboration with Dubavision, the partner acknowledges having read and fully accepted the legal terms and conditions published on our website, without reservation.
1. Terms of Service
These Terms of Service apply to website design, development, hosting management, and related services delivered by Dubavision. When you place an order, pay an invoice, or send requirements, you agree to these terms.
Scope of service
The scope is described in your quote, checkout confirmation, or email agreement. Work outside the agreed scope can require a new quote or extra fees.
Delivery and collaboration
Delivery timelines can vary depending on the project type, requested features, and third party factors. We aim to deliver efficiently and keep communication clear throughout the process.
Payments
Payments are due as stated at checkout or on the invoice from contact@dubavision.com. Late or failed payments can pause work and delivery.
2. Billing and Payments
Dubavision offers purchases as either a one time payment or a monthly subscription, as shown at checkout. By purchasing, you authorize Dubavision and its payment processor to charge your selected payment method according to the option you selected.
You are responsible for maintaining valid payment information. If a payment fails or is declined, we may suspend managed services until the account is brought current.
3. Cancellation and Service Suspension
You may request cancellation of a subscription at any time. Upon cancellation, hosting and managed services may be disabled the same day or within the days that follow, and access can be suspended without waiting for a future billing date.
Any outstanding balances, applicable fees, or invoices remain payable.
4. Early Termination Fees
If a subscription is cancelled early, fees may apply. These fees are determined at Dubavision’s reasonable discretion based on factors such as time invested, setup and configuration costs, discounts granted, third party licensing or tools, and remaining contractual value.
Early termination fees are payable upon invoice. If outstanding balances remain unpaid, we may suspend services and or access until payment is resolved.
5. Hosting Suspension and Site Ownership
Upon cancellation of a subscription, hosting and managed services are suspended. The website files and configuration remain stored by Dubavision.
Requesting full ownership
The client may request to obtain full ownership and independent control of the website. This may include export, transfer, documentation, and technical handover services.
Transfer fees
Website transfer and delivery of a complete package (files, database, and handover documentation) may involve additional fees. Transfer is completed only after all outstanding balances are paid (including any early termination fees, if applicable).
6. Security
Dubavision applies reasonable security practices to reduce risks. However, no website, hosting environment, or third party software can be guaranteed fully secure. Dubavision does not guarantee immunity from cyber attacks, vulnerabilities, or third party software flaws.
7. Pricing Changes
Dubavision may update pricing, subscription fees, or billing structures to reflect service improvements or cost changes. When applicable, changes will be communicated and apply at the next billing cycle unless otherwise stated.
8. Force Majeure
Dubavision is not liable for delays or failures caused by events beyond reasonable control, including network failures, third party outages, cyber incidents, power disruptions, or other force majeure events.
9. Governing Law
These terms are governed by the laws of Canada and the laws applicable therein.
10. Privacy Policy (Summary)
We collect only what is needed to deliver and improve our services. This includes contact details, project information, and technical data like analytics or error logs. We keep data secure, limit access to personnel who need it, and retain data only as long as necessary.

11. Refund and Cancellation
At Dubavision, we prioritize transparency and clarity in every transaction. Once a payment has been made for any of our website packages or services, the purchase is considered final and non refundable, unless otherwise required by applicable law.
12. Intellectual Property
You retain ownership of your pre existing content. Upon full payment of the project we grant you a license to use the delivered website for your business. Third party assets can be subject to their own licenses.
Our internal methods, code libraries, design systems, and templates remain our intellectual property. We can reuse non unique know how across projects.
13. Acceptable Use
Your website or content must comply with applicable laws and must not include abusive, fraudulent, infringing, or malicious material. Hosting providers can have additional rules that you must follow.
14. Third Party Services
We may integrate third party tools such as analytics, email, or payment platforms. These services have their own terms and privacy policies. It is your responsibility to review them.
15. Partnerships and Commissions
Dubavision may collaborate with creators, ambassadors, and partners across platforms such as TikTok, Instagram, and other digital channels. These collaborations are evaluated and approved at our sole discretion.
Commission percentages, partnership structures, eligibility requirements, and payment conditions are determined exclusively by Dubavision. We reserve the right to modify, reduce, suspend, or terminate any commission rate or partnership arrangement at any time, at our sole discretion, without prior notice.
Any projected earnings, examples, or performance estimates are for illustrative purposes only and do not constitute a guarantee of income. Actual results may vary depending on performance, audience engagement, and other market factors.
Unless a signed paper contract exists between both parties, no commission rate, payment structure, exclusivity, or partnership term is guaranteed or legally binding.
16. Limitation of Liability
To the maximum extent allowed by law, Dubavision is not liable for indirect or consequential damages, including lost profits or lost data. Our total liability related to a project is limited to the amount you paid for that project.
17. Indemnity
You agree to indemnify and hold Dubavision harmless from claims arising from your content, your misuse of the services, or your violation of these terms or of any laws.
18. Termination
We can suspend or terminate services if invoices are unpaid, if credentials are withdrawn in a way that prevents delivery, or if there is a breach of these terms. You can terminate at any time by written notice. Fees already due remain payable.
19. Changes to this page
We can update this page to reflect legal, technical, or business changes. The effective date at the top will show when the update takes effect.

21. Delivery Timelines and Start Conditions
Any delivery timeframe shown on a pricing page, in a message, or during a sales conversation is an estimate and not a guarantee. Delivery depends on the project scope, requested revisions, third party factors, and especially your responsiveness.
When the delivery timer starts (websites, menus, and related services)
The delivery timer starts only once we have received all required information needed to begin production. This includes, at minimum, the essentials required to build and publish (or stage) the project such as: (a) your business name and contact details, (b) content and brand assets (logo, text, menu items, photos, etc.), (c) access credentials when applicable (hosting, domain, WordPress, Google, etc.), and (d) a clear confirmation of your preferred structure and language.
If your process includes a form, onboarding link, or “website start” form, the delivery timer begins when that form is fully completed and all required materials are delivered in usable format. If information is missing, unclear, inconsistent, or unusable, the timer is paused until the missing items are received and validated.
Pauses caused by missing information or delayed approvals
If you do not provide required materials, credentials, confirmations, or approvals in a timely manner, Dubavision may pause work. Paused work may shift delivery dates without penalty. Repeated delays can require rescheduling and may create additional fees (for example, rebooking capture sessions, repeating exports, or redoing integration steps).
Revisions and scope changes
Requests that are outside the agreed scope, or major changes after approval (structure changes, full redesigns, new feature additions, new languages, new pages, new third party integrations, etc.) can extend delivery timelines and may require a new quote or additional fees. Approval checkpoints exist to keep projects moving: once a section is approved, later changes to that section may be treated as new scope.
Third party dependencies
Some deliverables rely on third party platforms and providers (hosting, DNS, payment processors, AR platforms, analytics tools, etc.). Dubavision is not responsible for delays caused by third parties, including outages, review times, verification steps, account holds, policy changes, or platform limitations.
22. 3D Capture, 3D Models, and AR Terms
This section applies to any service involving on site 3D capture, photogrammetry, scanning, interactive 3D models, AR experiences, 3D menu integration, and any related hosting or publishing of 3D content (collectively, “3D Services”).
Access, scheduling, and on site conditions
You are responsible for providing safe, legal, and timely access to the capture location. You must ensure staff availability as needed, provide access to the items to be captured, and confirm that the items are prepared in a presentable condition. If access is delayed, denied, or restricted, Dubavision may reschedule or cancel the session, and additional fees may apply.
You confirm that you have permission to allow capture in the location (including permission from landlords, management, or venue owners if applicable). You also confirm you have the right to request capture of the items provided (including dishes, packaging, brand elements, décor, or proprietary materials).
Food handling, safety, and responsibilities
Dubavision does not prepare food and does not guarantee compliance with any food safety standard for your operations. You are solely responsible for food handling, preparation, hygiene, allergen controls, and staff safety at the location. Dubavision may refuse to proceed if conditions appear unsafe, unsanitary, or non compliant with reasonable safety expectations.
Model accuracy and visual expectations
3D models are visual representations and can vary depending on lighting, material properties, reflections, condensation, sauces, steam, and real world texture behavior. While we aim for high quality results, you acknowledge that 3D output may differ from real life appearance, portion size perception, color tones, or texture details when viewed on different screens and devices.
You are responsible for verifying the final output before publishing. Once you approve a model or publish it (or request publishing), it is considered accepted “as is” and may require additional fees for major redo work not caused by Dubavision’s error.
Re shoots, corrections, and rescheduling
Re shoots may be required if items are unavailable, improperly prepared, or materially different from what was agreed. Re shoots may also be required due to factors outside our control such as severe reflections, missing reference markers, unsuitable lighting, location restrictions, or staff interruption. When a re shoot is required for reasons not caused by Dubavision, additional fees may apply.
Publishing, platforms, and third party limits
3D content may be delivered or published through third party platforms or viewers (for example, embedded 3D viewers, AR links, hosting services, or QR based AR platforms). These third parties may change features, pricing, policies, availability, rendering quality, compression, or supported formats. Dubavision is not responsible for third party changes or outages and does not guarantee indefinite availability of any external platform.
3D content hosting, retention, and removal
If your plan includes hosting or managed publishing for 3D content, continued availability may depend on an active subscription or active managed service. Upon cancellation or non payment, Dubavision may suspend hosting and access. We may delete or archive content after a reasonable period at our discretion, unless otherwise required by law or a written agreement.
Intellectual property for 3D models and deliverables
You retain ownership of your pre existing materials (brand, recipes, menu names, etc.). Unless otherwise agreed in writing, Dubavision retains ownership of: (a) raw capture data, (b) working files, (c) project presets, (d) internal pipelines and optimization methods, and (e) non unique know how. After full payment, you receive a license to use the delivered 3D outputs (final models, renders, and exported assets) for your business marketing and menu usage.
You may not resell, redistribute, or sublicense 3D deliverables as standalone assets (for example, selling the models to third parties, marketplaces, or licensing platforms) unless explicitly authorized in writing by Dubavision.
Permissions, people, and privacy
If any capture includes identifiable people, customer areas, private spaces, or sensitive information (screens, documents, addresses, etc.), you are responsible for ensuring proper consent and permissions. Upon request, Dubavision may blur or avoid certain areas, but we do not guarantee that accidental reflections or background elements will always be fully eliminated.
Compliance and prohibited use
You agree not to use 3D outputs for unlawful, deceptive, or infringing purposes. You are responsible for claims you make using 3D visuals (including ingredient claims, allergen claims, health claims, and product availability claims). Dubavision is not responsible for regulatory compliance of your menu or advertising.
Performance disclaimers
3D and AR experiences can improve presentation and engagement, but Dubavision does not guarantee outcomes such as increased sales, customer growth, conversion rate improvements, reviews, or revenue. Any examples or projections are illustrative only.
Limitation of liability for 3D Services
To the maximum extent allowed by law, Dubavision is not liable for indirect damages related to 3D Services, including loss of profit, loss of data, customer disputes, reputational impact, or third party platform issues. Our total liability related to 3D Services is limited to the amount you paid for the specific 3D Service in question.
